07/19/2019 - The lawsuit challenging the Florida Dietetics and Nutrition Practice Act in the United States District Court in the Northern District of Florida Pensacola Division would have had a dire impact on our profession. The outcome of the lawsuit was announced this week and is a victory for the public and for registered dietitian nutritionists. The court summarily dismissed the constitutional, factual and legal arguments brought by the plaintiff's lawyers, and granted the state's motion for summary judgment, upholding Florida's Dietetics and Nutrition Practice Act.
The Academy's Florida affiliate, its leaders, members and the Consumer Protection and Licensure Subcommittee for continued to work on this issue for nearly two years, holding FNCE sessions, increasing awareness, providing testimony, committing resources, and advocating with legislators.
Although the plaintiff's lawyers are likely to appeal, the Academy will continue to advocate for the public because it deserves the assured safety and effectiveness of licensed practitioners.
